Amnesty International Urges ICC to Address Delays in Nigerian Investigation

In a recent development, Amnesty International has formally petitioned the Pre-Trial Judges of the International Criminal Court (ICC) to expedite proceedings against Nigeria, urging an end to delays by the Prosecutor in initiating the investigation. The petition, submitted on behalf of war crimes and crimes against humanity victims in northeast Nigeria, highlights the prolonged wait for accountability in a region beset by violence from Boko Haram and Nigerian Security Forces (Jurist News).

Initiated in 2010, the ICC’s preliminary examination of the situation in Nigeria underscores significant findings that both Boko Haram and Nigerian Security Forces have engaged in acts of murder and torture, violating Articles 7(1)(a) and 7(1)(f) of the Rome Statute. In 2020, the then ICC Prosecutor Fatou Bensouda confirmed all criteria to open a full investigation had been met. However, challenges including prioritizing local prosecutions and the operational impacts of the COVID-19 pandemic have contributed to the delays in progressing to an official investigation.

Notwithstanding, Isa Sanusi, Director of Amnesty International Nigeria, emphasized that justice for Nigerian atrocities must be pursued with the same vigor as international law prosecutions elsewhere. He stressed the importance of the ICC’s commitment to justice for the victims, urging swift action to honor the rights and dignity of those affected.

The Deputy Prosecutor of the ICC, Mr. Mame Mandiaye Niang, recently reiterated the ICC’s stance on complementarity, which focuses on encouraging domestic authorities to address impunity. The ICC maintained that it remains committed to advancing investigations should domestic efforts prove ineffectual (ICC Situations).

This ongoing situation highlights tensions between international jurisdictions and local legal systems, raising questions about accountability and the efficacy of the ICC’s interventions in conflicts with strong local dimensions, such as Nigeria’s armed conflict involving Boko Haram and the Nigerian Security Forces.
