Transatlantic Differences in Litigation Funding Disclosure Practices: A European Perspective


The ongoing discussion surrounding litigation funding in Europe remains distinct from the debates in the United States, particularly regarding disclosure practices. During a forum at the New York University School of Law, experts highlighted that Europe’s legal funding landscape has not yet encountered the same level of contention as seen in the U.S. regarding the disclosure of litigation funding agreements.

Susanne Augenhofer, a professor at the University of Innsbruck and Yale Law School, noted, “We do not think or do not deem it necessary that the agreement itself should be disclosed. Yes to disclosure, but only to the identity of the funder and the fact that a third-party funder is involved.”
