Australia Targets Tech Giants with Proposed $50 Million Fines for Anti-Competitive Conduct

The Australian government has announced a proposed legal framework aimed at imposing significant fines on global technology companies for engaging in anti-competitive behavior and practices that obstruct consumer choice. Through this new regime, fines could reach up to $50 million AUD, marking a proactive stance against digital platforms perceived as “gatekeepers” in the nation’s economic landscape.

This proposed competition scheme stems from the findings of the September 2022 Digital Platform Services Inquiry Report conducted by the Australian Competition and Consumer Commission (ACCC). The report indicated that existing competition provisions were insufficient to counteract the monopolistic practices of companies like Google, Apple, Meta, Microsoft, and Amazon. In response, the government accepted the ACCC’s findings and collaborated in formulating this new legislative proposal.

As detailed in a statement from Assistant Treasurer and Minister for Financial Services Stephen Jones, the focus will initially be on app stores and ad technology, with social media platforms also being a priority for investigation. Criticisms have included accusations of app stores prioritizing their own products over competitors’ offerings and enforcing restrictive payment systems that elevate costs and limit consumer choices.

The legislative push is part of a broader global trend to clamp down on the power of technology companies, similar to efforts in the European Union, United Kingdom, and Japan. The backdrop to this initiative includes the Australian government’s recent enactments, such as legislation banning under-16s from social media, while also choosing to abandon proposed misinformation regulation laws.

As the proposed digital competition scheme progresses, the Australian government has opened the floor for public submissions, a move welcomed by the ACCC. This step indicates the government’s commitment to a transparent and participatory legislative process aimed at reforming digital platform regulations in Australia.
