UN General Assembly Seeks International Court’s Guidance on Israel’s Humanitarian Aid Duties to Palestinians

The United Nations General Assembly has formally adopted a resolution requesting an advisory opinion from the International Court of Justice (ICJ) on Israel’s humanitarian aid obligations to Palestinians. This move, supported by 137 member states with only 12 opposing, underscores the growing international concern about the humanitarian crisis facing Palestinians. Spearheaded by Norway and backed by a coalition of 22 countries, the resolution aims to mandate Israel to cease actions that obstruct the delivery of essential services and humanitarian aid.

Norway’s Deputy Foreign Minister Andreas Kravik spoke on the resolution’s passage, stressing that impediments to aid access can no longer be tolerated by the international community. Legal clarity from the ICJ could provide a framework for holding Israel accountable under international law, thereby facilitating unhindered humanitarian assistance to affected regions.

This decision by the General Assembly comes amidst a string of UN resolutions aimed at alleviating the humanitarian crisis in Gaza. These resolutions have condemned Israeli restrictions on the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) and called for an end to actions that compromise aid delivery.

Over 45,000 Palestinians have been killed since hostilities surged in October 2023, according to UN reports, with non-combatants, including a notable number of women and children, constituting a significant portion of casualties. A report by the Gaza Ministry of Health in March documented more than 13,300 child fatalities due to the conflict, further emphasizing the vulnerability of the region’s youngest populations.

The demand for the ICJ’s advisory opinion could be pivotal in establishing a clearer legal mandate for Israel regarding its obligations and responsibilities towards Palestinians, potentially setting the groundwork for renewed diplomatic and humanitarian efforts in the region.
