South Korean Democracy Tested as Impeached President Yoon Faces Arrest Warrant Amidst Political Turmoil

South Korea’s political landscape has been further shaken by the recent actions of its prosecutorial authorities. On Monday, the Public Prosecutor’s Office sought an arrest warrant for the country’s impeached President Yoon Seok-Yeol. This move comes after Yoon’s contentious martial law declaration earlier this month.

The request was filed with the Seoul Western District Court, prompted by Yoon’s failure to respond to a third summons from the Corruption Investigation Office for High-ranking Officials. Scheduled for last Sunday, this was part of ongoing proceedings after the former president did not attend previous meetings. Yoon stands accused of organizing an insurrection and obstructing government functions.

Yoon has justified his absence, arguing that the Public Prosecutor’s Office lacks the mandate to investigate charges of insurrection. Citing the constitution, he emphasized that a sitting president has legal immunity, except in cases related to treason or insurrection. However, the Prosecutor’s Office contends that the authority to investigate abuses by high-ranking officials, like Yoon, lies under their jurisdiction.

Yoon’s decision to declare martial law on December 3, 2024, was ostensibly aimed at countering pro-North Korean forces purportedly affiliated with the opposition Democratic Party. Following the declaration, the military and police cordoned off the National Assembly. However, the parliament, which was in session with 190 members, unanimously voted to revoke martial law shortly thereafter.

By December 14, South Korea’s National Assembly moved decisively, impeaching Yoon with a significant two-thirds supermajority. The motion accused Yoon of violating the Constitution, contending that he opportunistically used martial law powers for his ends rather than national security.

The Constitutional Court now has a timeframe of 180 days to reach a verdict on Yoon’s impeachment, a decision that could have significant repercussions for the nation’s political direction. Meanwhile, further political ripples were observed as Acting President Han Duck-soo was also impeached for not filling essential vacancies within the Constitutional Court, raising concerns over justice administration amid political volatility.
