CNN Reaches $5 Million Settlement with Veteran Over Defamation Case

CNN has agreed to a settlement of $5 million with Zachary Young, a US Navy veteran and security contractor, marking the conclusion of a legal dispute centered around defamation. The Florida First District Court of Appeal previously affirmed that CNN was liable for defaming Young. The court’s decision upheld that CNN’s statements insinuated Young was demanding “exorbitant prices” for evacuating individuals from Afghanistan post the US withdrawal in August 2021.

The settlement came after the appellate court sustained the trial court’s decision, awarding Young and his firm, Nemex Enterprises, significant compensatory damages. Despite reaching a settlement, both parties have opted to keep further specifics confidential. An official from CNN commented, “We remain proud of our journalists and are 100% committed to strong, fearless and fair-minded reporting at CNN, though we will of course take what useful lessons we can from this case” (CNN).

The controversy erupted following a CNN broadcast on November 11, 2021, via The Lead with Jake Tapper. The segment portrayed Young as an illicit profiteer capitalizing on “desperate Afghans” during the withdrawal. However, Young maintained during the trial that his company, Nemex Enterprises, conducted evacuations at the behest of corporations and charities. He emphasized that his firm did not charge the Afghans and actively dissuaded them from contacting his company.

In response to CNN’s appeal, the network argued that its reporting was deeply rooted in either opinion or ambiguous language, emphasizing its commitment to journalistic integrity in its internal communications. However, the jury found clear evidence of false statements, revealing CNN’s willingness to publish with “deliberate intent and actual malice.” The jurors noted a failure by CNN to adequately verify facts with Young, offering minimal time or opportunity for him to respond.

Young, in a subsequent interview with BBC News, remarked that the lawsuit’s essence was about “holding CNN accountable.” Despite the favorable ruling, Young had faced severe personal and professional repercussions, witnessing his business collapse and his consulting revenues reduced to zero since the CNN report.
