In the midst of ongoing ceasefire negotiations between Hamas and Israel, Amnesty International has called for the immediate and unconditional release of hostages and detainees, regardless of the outcomes of these talks. This call spans both the Israeli and foreign civilians currently held by Hamas, as well as the Palestinians who remain in detention in Israel, many of whom are held without charge or trial under the Unlawful Combatants Law.
The rights group emphasizes that the detention practices in Israel contravene Article 9 of the International Covenant on Civil and Political Rights, which explicitly safeguards individuals from arbitrary arrest or detention and ensures the right to a timely trial. Currently, 59 hostages remain in Gaza, with most being Israelis, while over 4,000 Palestinians are detained in Israel. The organization highlighted previous occurrences, such as the parading and subsequent shooting of six hostages by Hamas in 2024, acts which have also been scrutinized under international humanitarian laws, notably Article 3 of the Geneva Conventions.
Meanwhile, Egypt has stepped into a mediating role, as negotiations progress towards a potential permanent ceasefire in Gaza. These discussions aim to resolve contentious issues, including the return of hostages and the withdrawal of the Israeli Defense Forces from Gaza. However, Amnesty’s reports caution against making these humanitarian releases contingent on diplomatic resolutions. As the international community continues to focus on these developments, the rights of those detained must remain a critical aspect of diplomatic dialogues in the region.
