The request was turned down by Judge Susan Illston due to the ongoing appeal by Yu, which she noted could affect the court’s decision on the sanctions motion.
Yu, who held a position as a U.S.-based engineering executive for ByteDance, previously saw his whistleblower claims unravel owing to faked evidence. Nevertheless, his appeal remains active, currently pending before the U.S. Court of Appeals for the Ninth Circuit. This pending appeal was central to Judge Illston’s choice to deny ByteDance’s sanctions request at this time. The denial was, however, not final; ByteDance has the opportunity to refile its motion after the appeal process is concluded.
The tech conglomerate initially sought these sanctions as a repercussion for the alleged conduct of Yu’s attorneys during litigation. This legal development comes at a time when tech companies are increasingly grappling with the complexities of whistleblower cases and the legal challenges they present.
