Justice Department Challenges Block on Dismantling Consumer Financial Protection Bureau

The U.S. Department of Justice has formally appealed a decision by a federal judge that blocked the Trump administration’s attempt to dismantle the Consumer Financial Protection Bureau (CFPB). As reported in the National Law Journal, DOJ attorneys argued that the district court’s preliminary injunction excessively interferes with the Executive branch’s lawful discretion, contradicting the principles of the U.S. constitutional system.

This legal manoeuvre follows the issuance of a preservation order, implemented to prevent mass dismissals within the CFPB. The DOJ’s appeal stance contends that the court’s injunction constitutes undue micromanagement, highlighting a significant dispute between the powers of the judiciary and the executive over the future of the agency.
