Federal Judge Upholds $1.54 Million Award in Missouri Truck Dealer Contract Dispute

Recently, a federal judge resolved a $1.54 million contractual dispute involving a Missouri-based truck dealer and a defendant who failed to compensate for an order of composite trailers. In his decision dated March 28, U.S. District Chief Judge Stephen R. Clark of the Eastern District of Missouri awarded the sum to the plaintiff, Trans Advantage. Judge Clark’s ruling was decisive under Federal Rule of Civil Procedure 56(f)(3). This rule permits the court to consider summary judgment on its own initiative when no material facts are in dispute. On March 19, the judge had notified the parties of potential plaintiff-favorable rulings concerning breach of contract and negligent misrepresentation claims against the defendant, LTE Trucking.
