Georgia Senate Approves Riley Gaines Act: A Critical Move in Transgender Athlete Legislation

The Georgia Senate has passed the Riley Gaines Act of 2025, mandating that transgender athletes must participate in sports according to their biological sex. This legislation, initially known as the Fair and Safe Athletic Opportunities Act, intends to create “sex-specific athletic teams” and prohibits males from competing in women’s sports, and vice versa, unless the team is explicitly labeled as “coed.”

Former collegiate athlete and women’s rights advocate Riley Gaines, whose experiences prompted support for this legislation, argued that the previous rules disadvantaged female athletes when biological males were allowed to compete in female categories. Her story, involving shared locker rooms and competitive spaces with transgender athletes, brought attention to potential violations under the Title IX Civil Rights Act.

The Act replaces the term “gender” with “sex,” defining it based on “a student’s biological sex and genetics at birth.” Lieutenant Governor Burt Jones expressed gratitude to the female athletes who shared their stories, stating that the legislation protects their rights. In a statement, Jones highlighted the anticipated enactment of the measure, waiting for Governor Brian Kemp’s approval.

This development follows Georgia’s 2022 initiative with HB1084, which formed a committee to address male participation in women’s high school sports. Governor Kemp then mentioned the goal of keeping “woke politics” out of schooling and sports saying, the state’s approach puts students and parents first.

Nationally, the Act aligns with a presidential executive order from the Trump administration, which aims to withhold funding from institutions allowing males to compete in women’s sports, citing the need for fair athletic opportunities. However, this executive action has garnered legal opposition in New Hampshire for allegedly infringing upon the Fifth Amendment, the Fourteenth Amendment, and Title IX protections.
