South African Law Firms Challenge Government’s Ethnic Rating System in Court

Three prominent South African law firms, Webber Wentzel, Bowmans, and Werksmans, have allied with Norton Rose Fulbright in a legal opposition to South Africa’s recently introduced ethnic rating system. The firms contend that the Legal Sector Code, which sets a five-year target of achieving 50% black ownership, is unrealistic and could potentially hinder the economy. Their collective stance is encapsulated in a joint founding affidavit submitted to the High Court in Johannesburg, where they argue that the code, under the Broad-Based Black Economic Empowerment (B-BBEE) Act, is not only unworkable but also unsupported by empirical evidence.
