D.C. Updates Legal Ethics Rules to Emphasize Technology Competence for Lawyers

The District of Columbia has joined an increasing number of jurisdictions embracing the ethical duty of technology competence for lawyers. This development comes as the District of Columbia Court of Appeals has approved various amendments to the Rules of Professional Conduct for the D.C. Bar, including a noteworthy addition of technology to the definition of competent lawyering. However, the approach taken by D.C. deviates from that seen in other states.

While numerous states have mirrored the American Bar Association’s Model Rules of Professional Conduct since 2012, integrating technology competence into Comment 8 of Model Rule 1.1, D.C. has opted for a different route. Instead, D.C. has made its revision in Comment 5 under Rule 1.1, focusing on thoroughness and preparation. The new language emphasizes that the competent handling of matters includes the use of technology, alongside methods and procedures meeting competent practitioners’ standards. This nuanced approach highlights technology as integral to a lawyer’s management of specific legal matters rather than a broad generalization under the umbrella of competence. Interestingly, this change comes shortly after the New Jersey Supreme Court chose not to adopt a similar duty of technology competence, though it did approve a tech-focused CLE requirement.

The District of Columbia Bar’s recommendation, documented in a 2020 report, proposed addressing the constant evolution of technology through Comment 5, rather than Comment 8 like other jurisdictions. Their rationale was to balance the existing requirement for competent representation, considering the legal knowledge, skills, and the thoroughness and preparedness vital for effective representation.
