DOJ Investigates Former Governor Cuomo Over Possible False Congressional Testimony on COVID-19 Report

The U.S. Department of Justice (DOJ) is conducting an investigation into former New York Governor Andrew Cuomo regarding testimony he provided to Congress. This development was initially reported by the New York Times. At the heart of the investigation lies a transcribed interview Cuomo gave to a Congressional Subcommittee in June 2024.

During the interview, Cuomo claimed he had no role in drafting or reviewing a 2021 report from the New York State Department of Health (NYSDOH). The report attributed the state’s nursing home policy failures during the COVID-19 pandemic to external factors, as opposed to controversial decisions made by Cuomo while he was governor. However, a memorandum released by the House Subcommittee on the Coronavirus Pandemic in September 2024 suggests that Cuomo’s testimony may be misleading. The document points to evidence indicating Cuomo was actively involved in creating the NYSDOH report. The memorandum is available through the House Committee on Oversight and Government Reform.

Representative James Comer, the committee’s chairman, urged the DOJ last month to initiate a criminal investigation, citing potential violations of 18 USC 1001. According to this statute, it is a federal offense to knowingly provide false statements to Congress. Under these legal provisions, Cuomo could face significant penalties if found guilty, including up to five years in prison and fines up to $10,000.

The case against Cuomo arrives as he endeavors to regain political standing by contending for the mayoralty of New York City in November. Having served as governor from 2011 to August 2021, he resigned following allegations of sexual misconduct. Cuomo’s candidacy has gained momentum, positioning him as a leading contender in the Democratic primary for the mayoral race, as he aims to challenge incumbent Mayor Eric Adams, who is running as an Independent. Meanwhile, Mayor Adams recently saw federal corruption charges against him dismissed by the DOJ.

The DOJ has not publicly confirmed the investigation, though several media outlets have verified the reports citing unnamed officials. For further details, you can visit the complete article on the JURIST – News.
