U.S. Securities and Exchange Commission’s Rule Proposal Process Under Scrutiny for Possible Executive Order Bypass

The U.S. Securities and Exchange Commission (SEC) appears to have potentially sidestepped a White House executive order in its decision-making process concerning certain rule proposals. This development, reported by the National Law Journal, has prompted scrutiny from various quarters, including those within government entities. Amanda Fischer, the policy director for Better Markets and a former chief of staff at the SEC, highlighted the growing confusion, stating that numerous individuals within the agency are uncertain about whether the SEC’s actions are being or were required to be reviewed by the White House. Such actions could raise questions about the adherence to procedural protocols and transparency in federal rulemaking processes.
