In a recent legal development, U.S. District Judge Gregory Woods dismissed a case that challenged the security of Visa Vanilla gift cards. The plaintiff, Ira Schuman, represented by law firm Wolf Popper, claimed that Visa’s branding led him to believe these cards were protected from scams. However, after the cards he gifted to employees were fraudulently drained, Schuman pursued legal action under New York’s deceptive practices act. The judge, ruling in the Southern District of New York, found no indication that Visa implied the cards were scam-proof.
Judge Woods emphasized that the Visa logo did not assure consumers of fraud protection, stating that card draining scams are “well-known and widely publicized.” Despite dismissing the complaint, the court provided Schuman the opportunity to amend and refile.
