Allegations of AI Fabrications Challenge Expert Testimony in Louisiana’s Social Media Law Case

In a recent legal development, clinical psychologist Dr. Anthony Bean, serving as an expert witness for the tech trade group NetChoice, has been accused of submitting a report containing AI-generated fabrications. The state of Louisiana’s attorneys have challenged the credibility of Dr. Bean’s testimony, stating, “Dr. Bean’s reliability is shot, and the proof is overwhelming.” Dr. Bean has not responded to requests for comment.

NetChoice, representing major technology companies, had engaged Dr. Bean to provide expert analysis in their legal challenge against Louisiana’s Senate Bill 162, a law imposing age-verification requirements on social media platforms. The controversy centers on allegations that Dr. Bean’s report included fabricated quotations and citations, purportedly generated by artificial intelligence tools.

In response to these allegations, NetChoice acknowledged errors in Dr. Bean’s report. A representative from the organization explained that after submitting what was believed to be the final version of the declaration, their counsel requested Dr. Bean to add a paragraph disclosing his hourly compensation. Dr. Bean then inadvertently sent a different version that misattributed his summaries of publications as direct quotations from the authors of those publications. The representative emphasized that all source publications discussed in the report were provided to the Attorney General and were not AI-generated hallucinations. However, due to these misattributions, NetChoice decided to withdraw Dr. Bean’s declaration and drop him as an expert in the case.

This incident highlights the growing concerns over the use of AI in legal proceedings, particularly regarding the accuracy and reliability of AI-generated content. The legal community is increasingly scrutinizing the integration of AI tools, especially in the preparation of expert reports and legal documents. The case underscores the necessity for rigorous verification processes to ensure the integrity of information presented in court.

As the legal battle over Louisiana’s Senate Bill 162 continues, the focus on the credibility of expert testimony and the role of AI in legal documentation remains a critical issue. The outcome of this case may set a precedent for how AI-generated content is evaluated and utilized in future legal proceedings.
