Newsmax Files Antitrust Suit Against Fox News Alleging Suppression of Conservative Media Competition

Newsmax has initiated an antitrust lawsuit against Fox News, alleging that the network has engaged in practices aimed at suppressing competition within the conservative media landscape. The lawsuit, filed in the U.S. District Court for the Southern District of Florida, contends that Fox has employed exclusionary tactics to maintain its dominant position in right-leaning pay television news.

According to the complaint, Fox has leveraged its market power to coerce television distributors into agreements that either exclude or limit the reach of competitors like Newsmax. These alleged practices include pressuring distributors to avoid carrying Newsmax or to place it in less favorable channel positions, thereby restricting its audience growth. Newsmax asserts that such actions have stifled its expansion and reduced consumer choice in conservative media offerings.

Newsmax CEO Christopher Ruddy emphasized the lawsuit’s objective to restore fairness in the media marketplace, stating that the legal action seeks to ensure that Americans have real choice in the news they watch. The company is pursuing unspecified monetary damages and a court order to halt Fox’s alleged anti-competitive behavior.

In response, Fox News dismissed the allegations, attributing Newsmax’s challenges to its own competitive shortcomings. A Fox News spokesperson stated that Newsmax cannot sue their way out of their own competitive failures in the marketplace to chase headlines simply because they can’t attract viewers.

The lawsuit also accuses Fox of employing intimidation tactics, such as discouraging guests from appearing on Newsmax and allegedly hiring private investigators to scrutinize Newsmax executives. These actions, according to the complaint, are part of a broader strategy to undermine emerging competitors in the conservative news sector.

Legal experts note that the timing of this lawsuit could influence public perception, especially given the recent legal settlements involving both networks. Newsmax recently agreed to pay $67 million to Dominion Voting Systems to settle a defamation lawsuit over false claims related to the 2020 election. Similarly, Fox News settled a defamation lawsuit with Dominion for $787.5 million in 2023.

The case has been assigned to U.S. District Judge Aileen Cannon, a Trump appointee, and is expected to draw significant attention as it unfolds, potentially reshaping the competitive dynamics within conservative media.
