AI-Powered Arbitrator Revolutionizes Construction Dispute Resolution Ahead of AAA’s Centennial

As the American Arbitration Association (AAA) nears its 100th anniversary, it is embracing new technology to stay ahead in the dispute resolution field. This November, the AAA plans to introduce its first AI-powered arbitrator specifically designed to manage documents-only construction disputes. The Association sees potential in utilizing artificial intelligence to expedite case processing and cut costs, targeting a reduction in arbitration expenses by up to 50%, and case duration by 25 to 30% at rollout, according to the organization’s president and CEO, Bridget Mary McCormack.

The AI system is prepared to take on a significant volume of construction disputes, with an eye toward expanding into insurance cases soon. This development marks a pivot toward leveraging AI to complement human arbitrators, establishing what Diana Didia, AAA’s chief technology and innovation officer, describes as a powerful “muscular co-pilot.” The system was rigorously trained on over 1,500 actual construction awards provided by the AAA-ICDR’s case repository.

This AI arbitrator employs a “human-in-the-loop” framework, ensuring human review and validation at critical stages. This design aims to reduce the possibility of oversight common in traditional dispute resolutions by presenting its analysis to disputing parties for validation before producing a draft award. Human arbitrators then finalize the award after reviewing the AI’s recommendations.

Notably, this initiative reflects a continuing trend toward increasing the accessibility and efficiency of arbitration services. The projected reductions in both cost and complexity could create more opportunities for disputing parties to utilize arbitration over traditional court procedures. It could also maintain continuous engagement for human arbitrators, according to McCormack, as they adapt to these new AI-assisted processes.
