The court pointed to Lai’s role at Apple Daily during the proposal of a controversial 2019 extradition law, alleging he solicited international sanctions against China and the Hong Kong Special Administrative Region (HKSAR) government. The judge’s decision indicated that although Lai tempered his pro-democracy activism following the law’s enactment, he continued to infringe it through the editorial stance of Apple Daily. Despite these charges, many rights commentators assert that Lai’s conviction is detrimental to the freedoms of the press.
Lai’s family and supporters have vehemently rejected the verdict. Sebastian Lai, his son, emphasized that this legal action is targeted at Jimmy Lai’s journalistic integrity and democratic efforts. He called on the UK government to intervene, as Jimmy Lai is a British national. Caoilfhionn Gallagher, international counsel for Lai, criticized the conviction, arguing that it tarnishes Hong Kong’s once-respected legal framework and unfairly targets a dedicated publisher and peaceful pro-democracy advocate.
This verdict is the latest in a series of legal actions that have challenged Hong Kong’s judicial independence in recent years, prompting concern from international observers. The resignation of several foreign judges in 2024 over fears that their participation might contribute to legitimizing constraints on civil liberties adds to the unease.
