British Labour MP Jess Asato has initiated legal proceedings against Elon Musk’s artificial intelligence company, xAI, seeking a court order to prevent its chatbot, Grok, from generating non-consensual sexualized images of her. Asato contends that Grok’s capabilities infringe upon women’s personal autonomy by enabling the digital manipulation of their images without consent.
In June, Asato filed a claim alleging that xAI violated UK data protection laws and misused private information. She announced the legal action on X, with her legal team describing it as a pioneering case against non-consensual, sexualized AI content. The claim, submitted to the High Court in London, accuses xAI of breaches of data protection law and misuse of private information, seeking damages and a formal declaration that the conduct was unlawful. The lawsuit centers on Grok’s “system prompt,” which, according to Asato’s lawyers, lacked restrictions on generating sexualized or offensive images of real adults. The prompt instructed the model to “assume good intent,” allowing it to process prompts that other chatbots would typically refuse. The claim further alleges that xAI weakened earlier safety filters and, around January 9, moved a “spicy mode” behind a paid subscription. Asato is seeking a declaration, damages—including aggravated damages—and compensation under Article 82 of the UK General Data Protection Regulation (GDPR). She has also requested a compliance order under section 167 of the Data Protection Act 2018, requiring xAI to delete all copies of the images and implement effective and permanent technical measures to prevent Grok from generating images of her or training on her data. The case has garnered support from the UK government.
