Bombay High Court Halts Exit Notice Against Imran Khan Amid Legal Challenge and Protests

The Bombay High Court recently intervened to pause the “Leave India Notice” served to Bollywood actor Imran Khan by the Foreigners Regional Registration Officer (FRRO) in Mumbai. This notice, dated October 14, 2026, demanded that Khan leave the country by October 28. However, the court has deferred this directive until November 2, providing temporary relief for Khan during an ongoing legal challenge, identified as Imran Khan Pal v. Union of India & Ors., Writ Petition (L) No. 36271 of 2026. This decision follows a request for postponement by the Additional Solicitor General of India.

Khan, a U.S. citizen holding an Overseas Citizen of India (OCI) card, opposed the notice by filing a petition on October 17. His legal representatives argue that the notice, issued under the Immigration and Foreigners Act, 2025, is invalid due to its generic nature and lack of a prior hearing. Khan contends that the notice was triggered merely by his attempt to join a protest against alleged irregularities in the Election Commission of India’s Special Intensive Revision (SIR) of electoral rolls, a process under scrutiny for potentially disenfranchising millions of voters.

The legal framework governing OCI status provides that any cancellation of this status must be accompanied by a hearing, as mandated by the Citizenship (Amendment) Act, 2019. Khan’s argument is rooted in the belief that the principles of natural justice should apply equally, irrespective of which statutory route the government adopts to effectuate removal from India. These concerns resonate amidst accusations by opposition parties and civil society groups that the SIR exercise disproportionately impacts the poor and migrant communities, igniting further political controversy.

The demands for resignations within the Election Commission, including that of Chief Election Commissioner Gyanesh Kumar, emerged amid allegations of partisan conduct favoring the ruling Bharatiya Janata Party (BJP). An ongoing investigation at the Supreme Court continues to probe these allegations, with the Court recently granting a response window to the petitioners challenging the SIR’s legality.

Imran Khan’s legal battle epitomizes larger tensions over electoral integrity and civil rights in India, drawing attention to the balance of individual rights against state security measures. The high stakes of this judicial confrontation underscore the complex interactions between citizenship rights and political activism, vividly reflecting broader democratic challenges in the country.
