India Restores Opposition Leader Rahul Gandhi’s Parliament Membership Following Supreme Court Stay

In a significant turn of events, India’s lower house of parliament, the Lok Sabha,
restored the membership of opposition leader Rahul Gandhi following a Supreme Court stay of his previous defamation conviction.

The reinstatement came after the apex court’s decision put his 2019 defamation conviction on hold. In the case, Gandhi, a key figure in the Indian National Congress (INC), India’s main opposition party, was
charged with defamation against Indian Prime Minister Narendra Modi. He has also frequently clashed with Modi and his political party, the Bharatiya Janata Party (BJP), on various national issues.

Following the news about the parliament’s decision to restore Gandhi’s membership, several members, including Samajwadi Party MP Dimple Yadav and fellow INC member Randeep Surjewala, publicly congratulated Gandhi and expressed their support.

Under Indian law, candidates guilty of election offenses such as “promoting enmity between two groups” can be
disqualified. Yet, Gandhi’s legal team has always contended that his comments were aimed at exposing corruption in the country.

While the stay of conviction allows Gandhi to contest a general election next year, it does not overturn the conviction. Gandhi’s next legal steps reportedly include efforts to overturn the conviction altogether.

BJP representatives maintain that Gandhi’s conviction was fairly delivered and that full due process under the law was accorded to him.
