Trump’s January 6 Trial: Potential Outcomes and Political Repercussions

As the eyes of the world focus on the indictment of former President Donald Trump, uncertainty surrounds the timing, process, and potential outcome of the impending January 6 case. The trial, which is expected to last for about three months, will examine various conspiracies associated with Trump’s alleged attempts to hold onto power post the 2020 election.

With guesses suggesting the case may be set for trial in mid-March 2024, the verdict would not be revealed until the Republican primary season has ended. Alternatively, should the trial be deferred to mid-July, the verdict could potentially be delivered in mid-October, just in time to deliver a significant pre-election surprise.

Should the trial be carried out, some have suggested that it be televised. Advocates for this mode of dissemination argue that the seminal nature of the issues at hand warrants an exception from the standard practices of the Judicial Conference of the United States. Their opposition, however, is skeptical of the potential for such a change to be enacted under the consideration of the current Congress.

Speculations about the outcome are rampant. However, an analysis by Mark Herrmann suggests that the trial will either result in a verdict of guilty or a hung jury, wherein the jury cannot reach a unanimous decision. He highlights the Democratic-leaning tendency of those residing within the District of Columbia and draws attention to an abundance of credible evidence against Trump, including revelations from the January 6 Committee hearing.

Pay close attention to the day after the verdict as well. Herrmann predicts that prominent witnesses, many of whom likely were formerly loyal to Trump, will likely usher in substantial changes to the political landscape in the case’s aftermath.

Key witnesses such as Michael Pence and Mark Meadows, loyalists turned potential critics, will be essential to the prosecution’s case. Notably, Pence may reveal damaging evidence, such as Trump’s appraisal of Pence as being “too honest”. Moreover, increased scrutiny and challenges during the trial might lead to a potential withdrawal of support from these and other witnesses, causing them to pivot politically. Their future roles could range from becoming outspoken critics to lending support to Democratic campaigns.

This analysis is part of a broader reflection by Mark Hermann, who has strong expertise in legal matters from his 17-year tenure as a partner at an international law firm and is currently serving as a deputy general counsel at a major international company. He has penned several works including, The Curmudgeon’s Guide to Practicing Law and Drug and Device Product Liability Litigation Strategy.

His reflections on the case, its potential impact and the future for key witnesses can be found on his article titled “The Day After The January 6 Verdict“.
