Following the dismissal of Johnson & Johnson’s second talc bankruptcy, plaintiffs’ lawyers are showing a renewed commitment to their plans of pursuing trials nationwide. The leading attorneys in the talc multidistrict litigation, have suggested a bellwether trial plan in a letter to the judge on August 11. This proposed strategy includes the pursuit of consolidated trials with two or more plaintiffs, a departure from the original schedule presented prior to the first talc bankruptcy in 2021.
However, Johnson & Johnson’s attorneys expressed vehement opposition to this proposed plan. In a letter delivered to U.S. District Judge Michael Shipp, who is presiding over the multidistrict litigation in the District of New Jersey, on Wednesday, the healthcare giant’s legal team outlined their strong disagreement with the concept of consolidated trials.
