Elysium Health to Pay $3.6M in Damages Following Patent Infringement Verdict

Following the recent patent infringement trial, Elysium Health is now obligated to compensate W.R. Grace. The court case, held at a Delaware federal court, was based around the infringement of W.R. Grace’s patents, relating to its Tru Niagen brand of vitamin B3 supplements. The jury, having reached their verdict last Friday, agreed that Elysium Health had willfully violated these patents.

Based on the infringement, Elysium Health now faces the necessity to cover the cost of $3.6 million in damages arising from the sales of its Basis supplement. Further complicating the matter is the potential of these damages being trebled, a conclusion that could drastically increase Elysium Health’s financial burden.
