The Financial Conduct Authority (FCA) in the United Kingdom has initiated a consultation on its strategy to integrate the EU’s insurance distribution regulations into the FCA Handbook. The provisions of the Insurance Distribution Directive (IDD), which were implemented in the UK in 2018, caused notable changes to the FCA Handbook rules. Supplemental requirements were incorporated through various delegated regulations, which were defined as the IDD delegated regulations. Post-Brexit, these became part of retained EU law. The proposed plan includes repealing these IDD delegated regulations once each requirement has been transferred to the FCA Handbook.
The process initiated on 5th of the current month and spearheaded by Hogan Lovells, aims to provide clarity and direction to the regulations that govern the UK insurance industry. The FCA consultation signifies a pivotal effort to manage the transitional phase and ensure the continuity of a cohesive and effective regulatory framework.
