In a recent ruling, a Texas federal magistrate judge has recommended against granting Canadian band Nickelback’s request for $592,000 in attorney fees following a copyright infringement suit. Back in September, the band had succeeded in dismissing the copyright infringement suit brought about by the songwriter. Despite this victory in court, their subsequent attempt at being compensated for the legal expenses they incurred during the suit has met with resistance.
The judge’s recommendation serves to underscore a crucial point in such legal battles: the dismissal of a case does not necessarily render the charges that were brought against the defendant “frivolous”. Hence, escaping a lawsuit does not automatically qualify the victorious party for attorney fees.
