Emerson Radio Corp recently saw a landmark judgment in its favor in a trademark infringement suit. The well-known electronics company was granted around $3.1 million in attorney fees following their $6.5 million default victory. This case took place within the jurisdiction of a Delaware federal court just days ago.
The presiding federal judge was explicit in his assertion that the censure and subsequent fees leveled against the defendants were due to their “unreasonable” conduct during litigation. This conduct remains to be further defined and elaborated.
Legal professionals and corporations alike would be well-advised to examine this case; what is clear is that the dynamics of contemporary trademark infringement suits continue to evolve.
