Minnesota Completes Nationwide Adoption of Survivorship Bills: A New Era for Medical Malpractice Justice

One of the latest milestones in the world of legal developments occurred recently in Minnesota. On May 20, 2023, the state passed the Survivorship Bill. This significant move made Minnesota the final state to pass such a bill, providing a much-expanded scope of justice for victims of medical malpractice and wrongful deaths.

This news was shared in volume 17, issue 2 of the Robins Kaplan Justice Report, a well-known legal publication. According to the report, the Survivorship Bill extends the range of damages that families can pursue following the loss of a loved one.

Liz Fors, who is the co-chair of the Legislative Committee for the Minnesota Association for Justice (MAJ), and also a partner at Robins Kaplan LLP, has said that the MAJ has been advocating on behalf of consumers for over a decade to have this particular bill passed.

The passage of this bill marks a critical extension in the rights of families affected by wrongful death or medical malpractice. Legal professionals, especially those working within the fields of healthcare law and family law, should be aware of these changes and the new avenues of justice it opens for their clients.

Hence, this Survivorship Bill is a significant development for the justice system in Minnesota, and also for the rest of the country, providing a fresh perspective on how justice can be pursued on behalf of those wronged by the healthcare system.
