As of October 19, 2023, Israeli citizens who travel to the United States for business or pleasure no longer need to apply for a visitor visa. Instead, they are now able to enter the U.S. through the Visa Waiver Program by obtaining ESTA (Electronic System for Travel Authorization) Travel Authorization. This milestone was announced on JDSUPRA and has been confirmed by Tarter Krinsky & Drogin LLP.
What is significant about this decision is that the U.S. Visa Waiver Program allows citizens of participating countries to travel to the United States without a visa for stays of 90 days or less, when they meet all requirements. This aims to strengthen bilateral relationships between the U.S. and the respective participating countries, facilitating efficiency and ease of travel.
The introduction of Israel into the program represents a recognition of its status as a reliable security partner and signifies a deepening of the each nation’s bilateral relations. It could also have a meaningful impact on the cultural and economic exchange between the two countries.
However, all legal professionals should note that travelers must have a valid Electronic System for Travel Authorization (ESTA) approval prior to travel. It should be noted that an ESTA is not a visa and does not meet the legal requirements to serve in lieu of a U.S. visa when a visa is required under U.S. law. Furthermore, national security and law enforcement agencies within the U.S. continue to determine eligibility for the program. They also reserve their right to revoke ESTA authorizations at any time without requiring a justification.
