Majority of US States Embrace Remote Work Legislation for Mortgage Professionals

The landscape of remote work for Mortgage Loan Originators (MLOs) and mortgage company employees is rapidly changing in favor of flexible work conditions. The majority of American states are now allowing MLOs and mortgage employees to work remotely, and this changing trend signifies a fundamental shift in the way this industry operates.

The latest state to join the group is Illinois, which legislatively authorized remote work for MLOs and mortgage company employees on June 9. This move followed similar changes in a growing number of states, including five others that have adopted such authorizations since Montana enacted a similar law in March.

The changes represent a reaction to the global pandemic and the societal move toward remote ways of working. The expectation is that more states will pass similar laws in their 2024 legislative sessions.

As a result of these legislative changes, MLOs and mortgage employees are given the opportunity to work from the location of their choice, offering advantages such as better work-life balance and increased flexibility. Arguably, it could also allow companies to cast a wider net in their recruitment efforts, potentially attracting a more diverse pool of applicants.

However, this shift is not without potential challenges. Regulatory requirements, information security, and standardization of practices across different jurisdictions could be some of the hurdles these firms might face.

Despite these challenges, the governing bodies in the majority of states deem the benefits of remote work to outweigh its downfalls. With time, this trend of remote work policies for MLOs and mortgage company employees may not only become the new normal but also set a precedent for other sectors within the financial services industry.
