In a recently decided trademark dispute case, the makers of Little Trees air fresheners were told they can’t pursue a direct liability claim against Meta Platforms Inc. This decision was held in response to their lawsuit, where they alleged that counterfeit versions of their products were being sold on Facebook Marketplace. The ruling that came from a New York federal judge allows them to, however, continue with their claims that Meta permits the sale of these infringing products on its platform.
The alleged infringed items are air fresheners, which are known for their distinctive tree-like shape and are under the manufacture of the company Car-Freshner Corporation. This company argues that Meta Platforms, the parent company for Facebook, should bear responsibility for these counterfeit products made available for sale through its Facebook Marketplace.
