Hearst Newspapers has made an appeal to the U.S. Supreme Court to resolve an ongoing issue in copyright infringement law related to the timeline associated with the statute of limitations. The media giant is arguing that lower courts are currently misapplying what they deem as “a so-called discovery rule”. This rule, in its current form, allows potential claims related to copyright infringement to accrue when a plaintiff first identifies an infringement situation.
This request for judicial clarity comes as part of Hearst’s ongoing commitment to uphold copyright laws and protect intellectual property rights. In their view, a decision from the Supreme Court would provide the much-needed certainty and consistency for corporations dealing with potential copyright infringements.
