In the coming weeks, the Biden administration might support a World Trade Organization (WTO) proposal to waive key intellectual property protections related to COVID-19 tests and diagnostics. This decision is expected to take place at the WTO’s 13th Ministerial Conference in February.
However, according to former U.S. Circuit Judge Paul Michel, this step could have detrimental effects on the US industry. Michel, currently part of the Council for Innovation Promotion, argues that these intellectual property protections are vital for U.S. firms. They sustain millions of jobs and foster the development of life-saving treatments benefiting patients globally. This perspective suggests that waiving these protections might inadvertently harm the very industry that plays a pivotal role in the ongoing battle against the COVID-19 pandemic.
