Significant developments have been made in the disqualification case of opposition leader Afjal Ansari. The Lok Sabha secretariat of the lower house of the Indian Parliament has revoked the disqualification after Ansari was able to secure a suspension of his conviction. The conviction was under charges of the Uttar Pradesh state’s Gangster Act, an order granted by the Indian Supreme Court. Ansari is a member of Parliament (MP) from Ghazipur Constituency of Uttar Pradesh state and leads the political party of Bahujan Samaj Party (BSP).
Following the announcement of the Supreme Court’s order on December 14, 2023, the secretariat issued a notification stating that Ansari’s disqualification under Article 102(1)(e) of the Constitution and Section 8 of the Representation of the People Act, 1951, would no longer be in effect. Still, this suspension is subject to conditions imposed by the Supreme Court and subsequent judicial decisions.
In its judgment, the Supreme Court stated that Ansari’s conviction was suspended under specific conditions. Some of these conditions included a prohibition on notifying Ansari’s Ghazipur Parliamentary Constituency for a bye-election, barring the appellant from participating in parliamentary proceedings, voting, and receiving perks until the appellant’s criminal appeal is decided by the High Court. The court expressed no opinion on the case’s merits, leaving that decision in the hands of the High Court.
Ansari, who has a record of serving in legislative bodies, recently faced disqualification due to a trial court judgment. His disqualification stemmed from a conviction under the UP Gangsters Act, leading to a subsequent appeal to the High Court. The High Court granted bail and stayed the sentence but did not suspend the conviction, leading Ansari to approach the Supreme Court.

It ensures the safety and security of the public by employing specific measures to prevent and tackle activities of gangs and anti-social entities. It also bolsters law enforcement agencies by providing them with the tools and provisions required to curb the influence and operations of gangs and other anti-social elements.
