Earlier this week, Linde North America defended its position before the Third Circuit against a retirement benefits claim from the company’s former general counsel, who has since become a whistleblower. The former employee claimed that Linde had deprived him of more than $100,000 in retirement benefits. The crux of the dispute lies in the interpretation of the term “earnings” in Linde’s retirement program.
Linde contends that the term “earnings” is not ambiguous. The company thus argued that the Third Circuit should not revive the lawsuit brought by its former general counsel. The lawsuit was previously dismissed in a lower court.
