Blum and his legal team have recently set sights on a novel target: The United States Military Academy at West Point. Their objective is to challenge and potentially uproot the institution’s utilization of affirmative action in its admissions process. For a long time, the military has held an integral role in overcoming barriers of racial discrimination with initially diversifying its ranks. Regrettably, this initial move did not eradicate discriminatory practices, but it did contribute to the military becoming one of the pioneers of affirmative action, as outlined by the New York Times.
This policy, however, is now under threat as Blum & the Gang have chosen to legally contest the constitutionality of the practice, according to a report by Reuters. The U.S. Justice Department previously argued in court documents that the race-conscious admissions practices at West Point were essential to creating a diverse officer corps, reflecting the diversity of its enlisted personnel.
However, the task Blum’s team has undertaken is far from easy due to the important role that the military plays in American society and the strategic importance of maintaining diversity within it. Law firm giants Perkins Coie and Morrison Foerster once defended affirmative action, but given the clout and influence of the military, it’s difficult to envisage a more formidable defender of diversity.
West Point’s commitment to diversity and inclusion is not just historical. It plays out in the real world, through their current active recruitment strategies from minority communities. This approach demonstrates a longstanding tradition that dates back to its decision to desegregate, a significant progress step in promoting racial equity.
Interestingly, the end of affirmative action at West Point may have broader implications beyond admissions. For instance, it may impact military service benefits like the Public Student Loan Forgiveness plan that become more accessible through military service, as a 2020 youth poll by the Pentagon shows.
Given the importance of West Point as an institution and its role as a leading proponent of affirmative action, there is much at stake in this legal battle. The outcome could reshape not only the academic landscape but also the demographic fabric of future military leadership.
