Tom Girardi’s Mental Competence Debated Ahead of Separate Trials in California and Illinois

Tom Girardi, the 84-year-old lawyer currently residing in an assisted living facility, is preparing for a criminal trial set to take place in California in May this year. However, a separate trial in Illinois is not expected to commence until at least 2025. Both trials hinge on a crucial determination of Girardi’s mental competence, a subject currently under dispute by his legal representatives.

In early January, a federal judge in Los Angeles found Girardi competent to stand trial, with proceedings set to begin on May 21. However, during a telephonic hearing on February 2, Seema Ahmad, Girardi’s lawyer in the Illinois proceeding, appealed to US District Judge Mary Rowland in the Northern District of Illinois not to accept this ruling as a definitive evaluation of her client’s mental competence.

Though the Los Angeles ruling is binding for the forthcoming California trial, the question of whether Girardi is mentally capable of understanding the Illinois proceedings and assisting in his own defense is currently under review. Ahmad’s appeal opens the door for a new examination of Girardi’s cognitive abilities, featuring a potential second evaluation ahead of the Illinois trial.
