Rochester Murder Convict Released Due to ‘Anti-Shuttling’ Provision Oversight

In an unusual turn of events, a man from Rochester, New York, initially convicted for second-degree murder in October 2018, has been released from a maximum-security prison.

According to details from Rochester local news, the individual was set to face trial for murder, but due to legal complications, he experienced an unexpected release. His detention in the wrong prison prior to his murder trial invoked something called the ‘anti-shuttling’ provision, which ultimately led to his freedom.

For those unfamiliar, the ‘anti-shuttling’ provision is part of the United States Code Title 18 – Section 3568. This provision was established to restrict the movement of prisoners between different institutions, particularly in cases when an inmate has been taken from a jail where they were serving a sentence to another institution for trial on a separate charge.

If imprisonment resulting from the separate charge would result in a longer term of imprisonment, the clause stipulates that the detention period at any such institution prior to the trial would not exceed six months. If this period is indeed exceeded, the prisoner has to be returned to the jail where he had been serving the original sentence.

In the case of this Rochester convict, it appears that he was not returned to the original institution within the stipulated six-month period. As such, this lead to his release under the technicality outlined in the ‘anti-shuttling’ provision.
