Pharmaceutical heavyweight, Johnson & Johnson, is seeking dismissal from a proposed class action which accuses the company of attempting to quash competition for the immunosuppressive drug, Stelara. The proceedings have come to light amidst allegations that assert J&J enforced patent rights with intent to monopolize the Stelara market. Nevertheless, J&J insists upon their innocence, arguing against the existence of any “scheme” to enforce its patents.
These statements were made before a Virginia federal court on Tuesday, forming the basis for J&J’s dismissal request. With the pharmaceutical industry under increased scrutiny for anti-competitive practices, the outcome of this case could hold significant implications for future patent law rulings.
