Derek Smith Law Group Faces $81,439 Sanction for “Bad Faith Misconduct”

On April 24, 2024, it was ruled that Derek Smith Law Group PLLC was correctly sanctioned with an order to pay $81,439 in attorney’s fees to an opposing party. The sanction was upheld by a federal appeals court, saying that the firm, particularly an attorney named Johnmack Cohen had participated in “bad faith misconduct.”

The attorney’s were accused of misleading their clients, saying a competing lawsuit wasn’t relevant. The core of this issue traces back to a sexual harassment suit filed by a John Doe during 2018-2023, which has since been dismissed. The lawsuit was filed under John Doe 1 v. East Side Club held in the US District Court for the Southern District of New York.

The order imposes sanctions against the firm as a result of their work on the lawsuit mentioned above.

A three-judge panel of the US Court of Appeals for the Second Circuit asserted that both the firm and attorney Johnmack Cohen had indeed demonstrated bad faith misconduct.
