An Idaho-based physician specializing in maternal-fetal medicine has submitted a lawsuit to the U.S. District Court for the District of Idaho against the state and local officials responsible for enforcing Idaho’s prohibition on abortion. The physician, Stacy Seyb, has requested to ascertain that these abortion restrictions are unconstitutional and unenforceable.
Dr. Seyb’s area of expertise extends to providing care for individuals facing high-risk or complicated pregnancies. According to the complaint, despite multiple abortion bans being instituted in Idaho, there still exists constitutional protection for medically necessary abortions. This protection applies in cases where the continuation of a pregnancy may lead to grave medical risks for the pregnant individual, or where the pregnancy is deemed medically futile.
Stephanie Toti, Executive Director of the Lawyering Project, commented on the situation, calling the Supreme Court’s decision to overturn Roe v. Wade incorrect in legal terms and deeply detrimental to the rights and dignity of countless individuals. She stressed, however, that even by the ruling’s own terms, it does not apply to medically necessary abortions, which continue to be safeguarded by the constitution.
