In an escalating conflict over the interpretation of workplace discrimination laws, eighteen Republican-leaning states have filed a law suit against the U.S. Equal Employment Opportunity Commission (EEOC). The plaintiffs assert that the commission has overly widened its definition of gender-identity-based harassment in the workplace, thereby overstepping the boundaries set by federal laws.
At the heart of this dispute lies the EEOC’s new guidance on workplace harassment enforcement issued in April. As per the document, employers who refuse to use preferred pronouns of their transgender employees, or prevent them from accessing bathrooms that correspond with their gender identities, could be held accountable for workplace harassment under Title VII of the Civil Rights Act of 1964.
