An ongoing copyright case involving the iconic “smiley face” logo of the band, Nirvana, has been further complicated due to recent rulings. A past employee of the record company, who asserts that he was the original creator of the logo, has been stopped in his tracks by a California federal judge. He has been denied the chance to immediately appeal a previous ruling or delay the trial.
Said trial is proceeding against Marc Jacobs International LLC, a prominent fashion company. Allegedly, the designer used the Nirvana logo in one of their clothing designs without licensing or the due permission. This former employee intended to seize the opportunity to stake a claim in the ownership of the logo amidst the proceedings.
The federal judge’s decision now places a momentary halt on any appeals from the former record company employee, pushing forward the Nirvana’s copyright lawsuit against Marc Jacobs International LLC to its imminent trial.
