On Tuesday, a federal judge refused to dismiss the Federal Trade Commission’s (FTC) lawsuit against Amazon, which claims the company enrolled consumers into its Prime service without their consent and made it challenging for them to cancel their subscriptions. In its defense, Amazon argued that its Prime enrollment process did not violate federal laws, asserting that it had “clearly and conspicuously disclosed all material terms.”
Judge John Chun of the U.S. District Court for the Western District of Washington noted, “(V)iewing the Amended Complaint in the light most favorable to the FTC, the Court cannot dismiss the claim that Amazon’s ‘Iliad Flow’ cancellation method was not a ‘simple mechanism.'” The full article is available at National Law Journal.
