The U.S. Supreme Court on Monday declined to rule on the constitutionality of laws passed by Republicans in Florida and Texas, which regulate content moderation at large social media companies. Instead, the Court has remanded the case to the lower courts for a “proper analysis” of the First Amendment issues.
In its decision, the Supreme Court directed the U.S. Courts of Appeals for the Fifth and Eleventh circuits to reconsider the cases. The review will focus on whether the unconstitutional applications of the statutes “substantially outweigh” the constitutional ones.
