Federal Prosecutor Demoted Amid Misconduct Allegations Tied to Resigned Judge

An Assistant United States Attorney (AUSA) has faced significant professional repercussions after a misconduct complaint linked her to a recently resigned federal judge, Joshua Kindred. The prosecutor, Karen Vandergaw, was initially promoted to senior litigation counsel amid an ongoing investigation into Judge Kindred’s behavior. However, after allegations surfaced that Vandergaw sent nude photographs to Kindred, she has since been demoted.

The details of this scandal emerged through an article published by Above the Law. The complaint noted that Kindred, known for sharing inappropriate details with his clerks, had a flirtatious rapport with Vandergaw, leading to a problematic relationship.

Following the internal announcement of Vandergaw’s demotion, Bloomberg Law reported that she appeared in at least eight cases assigned to Kindred. In each of these instances, Kindred either recused himself or the cases were reassigned within a short period. Although some might argue these actions mitigated potential conflicts of interest, questions remain about the broader implications for other cases she may have influenced in her advisory role.

Jamie McGrady, Alaska’s chief federal defender, emphasized the seriousness of the situation by stating that efforts are ongoing to identify cases where the perceived conflict could undermine convictions or sentences. Given Vandergaw’s advisory duties, her influence extended beyond individual cases, affecting jury schedules and trial strategies.
