Legal Firms Awarded 25% of Requested Fees Following Complex False Advertising Verdict

The firms of Womble Bond Dickinson and McCarter & English have secured a quarter of their requested $4.78 million in fees following a $14.7 million win in a false advertising case. The decision came after a split jury verdict that highlighted the complexity of the case. U.S. District Judge Max O. Cogburn Jr. noted the jury’s mixed findings, which ruled for the defendants on trademark and fair use claims, supported the plaintiff on the Unfair and Deceptive Trade Practices Act (UDTPA) and the Lanham Act, and issued different rulings for the two defendants on copyright claims.
