The Ninth Circuit Court of Appeals recently upheld the dismissal of a False Claims Act (FCA) lawsuit filed by a patent attorney against Allergan and Adamas Pharma. The attorney had accused the pharmaceutical companies of fraudulently securing patents to thwart generic competition for two Alzheimer’s medications. The panel determined that the dismissal was warranted because the information provided by the attorney was already accessible to the public, effectively barring the FCA claims.
